In consideration of the promises contained herein, and for other valuable consideration, the receipt and sufficiency of which the Parties acknowledge, the Parties agree as follows

1. Payment:
   
   1. 50% of the full cost of reservation is due when the contract is accepted by Nottingham Shire and Carriage for Hire, LLC (hereinafter ÒNottinghamÓ)
   2. Remaining 50% of the full cost of reservation is due 24 hours prior to the reservation
   3. Failure to pay the remaining balance 24 hours prior to the reservation will result in cancellation of the reservation (see cancellation policy)
   4. Payment may be made by Credit Card or Debit Card on our secure website www.carriageforhire.com; over the phone; or by money order. Money orders should be payable to Nottingham Shire and Carriage for Hire, LLC. Sorry, but we are unable to accept personal checks.
2. Cancellation:
   
   1. If you fail to pay the balance due 24 hours prior to the reservation, your reservation will be cancelled. 50% of your deposit, less a $25.00 processing fee, will be refunded to you.
   2. If you wish to cancel your reservation, please provide 24 hours notice in writing via email or fax. 50% of your deposit, less a $25.00 processing fee, will be refunded to you.
   3. If Nottingham cancels your reservation due to unforeseen circumstances not within the companyÕs control, you will receive a full refund of any amounts you have paid.
      1. Nottingham will make all reasonable efforts to fulfill the contract in the event of an unforeseen circumstance.
      2. If Nottingham is able to fulfill the contract despite an unforeseen circumstance, there are no guarantees as to preferences.
      3. Unforeseen circumstances include, but are not limited to, mechanical failure of our fleet vehicles, damage causing carriage to be inoperable, interstate closures, death of a horse, or Acts of God.
      4. If you have paid extra for preferences, and those preferences cannot be honored due to unforeseen circumstances, you will receive a full refund of the amount paid for such preference.
3. Refunds
   
   1. Any refund due you in accordance with the terms above will be paid by company check and mailed to the address you provide on this contract within 30 days of cancellation.
4. Inclement Weather:
   
   1. We do work in rain (carriage has aonvertible top).
   2. We do not work in severe weather (lighting, snow, high winds).
   3. Reservations will be rescheduled, based on availability, due to inclement weather.
   4. There is no charge or refund for a rescheduled reservation.
5. Miscellaneous:
   
   1. WARNING:
      Under Georgia law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to Chapter 12 of Title 4 of the Official Code of Georgia Annotated.
   2. Fireworks and/or pyrotechnics, including but not limited to sparklers, firecrackers, smoke bombs are not permitted without prior approval. Failure to comply resulting in distress to the horse will force Nottingham to terminate the event due to safety. No refunds will be issued.
   3. Your signature on this contract is binding. Signatures by facsimile, or other means of electronic communication are considered originals.
   4. This Contract shall be binding on the parties hereto, their heirs, executors and administrators.
   5. If any provision in this Contract is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will nevertheless continue in full force without being impaired or invalidated in any way.
   6. Should it become necessary for Nottingham to institute legal proceedings to enforce collection of this contract, and Nottingham prevails, they shall be entitled to reasonable attorney fees.
   7. Venue for legal proceedings shall be proper in Fayette County, Georgia.
   8. This Contract will be governed by and construed in accordance with the laws of the State of Georgia.
   9. No addendum or modification to this Contract is valid unless signed by all parties.
   10. This Contract constitutes the entire understanding of the parties.
